Asbestos Removal (Class B) Course Overview

Asbestos remains New Zealand’s number one killer in the workplace, with many individuals exposed to it during their ordinary course of work. There is now a requirement under the Health and Safety at Work (Asbestos) Regulations 2016 , that all workers who may be exposed to this hazard, are made aware of the danger of Asbestos. If you work in building and construction or any sort of demolition or refurbishment that involves Asbestos Contained Material (ACM), you will need to obtain a WorkSafe licence by April 4th 2018.

Successful completion of the Asbestos Removal – Class B course, will enable you to attain unit standards (2138 & 29765), then your PCBU can apply for a Class B Licence with WorkSafe NZ to carry out the safe removal of any amount of Non-Friable Asbestos and Asbestos containing material (ACM).

Attendance Pre-requisites Hazard and Risk Management is strongly advised.
Who Should Attend? Anyone working on a site likely to contain Asbestos, or anyone who may be required to sample or remove any amount of Non-Friable Asbestos or Asbestos contained material. This includes builders, electricians, plumbers, drain layers and other trades.

Person conducting a business or undertaking (PCBU)

A PCBU is a ‘person conducting a business or undertaking’. While a PCBU may be an individual person or an organisation, in most cases the PCBU will be an organisation (for example, a business entity such as a company).An individual, such as a sole trader, can also be a PCBU.

Officer

A person who holds a very senior leadership position and has the ability to significantly influence the management of a business or undertaking. A business or undertaking can have more than one officer.

Worker

An individual who carries out work in any capacity for a PCBU

The short answer is – everyone:

  1. The business itself. A new legal concept will be a person conducting a business or undertaking (PCBU). A PCBU will usually be a business entity, such as a company, rather than an individual. The business will have the primary duty under the new law to ensure the health and safety of workers and others affected by the work it carries out. This includes other businesses that share a work site or contract to you or that are part of the supply chain. A property landlord, property manager and contractors/handyman engaged by a property landlord or property manager are also considered to be PCBUs.
  2. Officers. This includes directors and other people who make governance decisions that significantly affect a business. Officers have a duty of due diligence to ensure their business complies with its health and safety obligations.
  3. Workers must take reasonable care to ensure the health and safety of themselves and others, and to comply with the business’s reasonable instructions and policies.
  4. Other people who come to the workplace, such as visitors or customers, also have some health and safety duties. It’s all about taking responsibility for what you can control.
The Act creates three offence tiers relating to breaches of the health and safety duties. The offences and the respective maximum penalties can be summarised as follows:

  • Reckless conduct that exposes any person to risk of death or serious injury/illness and is reckless as to that risk – fines up to $3 million for the PCBU entity (or $600,000 for individuals) or 5 years in prison.
  • Failure to comply with a duty with exposure to risk of death or serious injury/illness – fines up to $1.5 million for the PCBU entity (or $300,000 for individuals).
  • Failure to comply with a duty without exposure to death or serious injury/illness – fines up to $500,000 for the PCBU entity (or $100,000 for individuals).
